Federal Mandates in the US
The US has implemented various healthcare reforms, laws, and regulations to increase patient safety and improve the quality of care and patient outcomes. Title XIII of the American Recovery & Reinvestment Act of 2009, also as known as the Health Information Technology for Economic & Clinical Health (HITECH) Act, is one such example of a federal mandate supporting hospital EHRs. The HITECH Act promotes the adoption of electronic health records to improve efficiency and lower healthcare costs. The Act has placed new requirements on healthcare organizations in terms of Meaningful Use criteria, which drives reimbursements (financial incentives) for the "Meaningful Use" of certified EHR technology. To receive an EHR incentive payment, providers must meet certain measurement thresholds to show that they are “meaningfully using” their certified EHRs. These thresholds range from recording patient information as structured data to exchanging summary care records. The Medicare and Medicaid EHR Incentive Programs include three stages with increasing requirements for participation. Stage 1 focuses on data capture and sharing while Stage 2 focuses on advanced clinical processes such as health information exchange and increased patient-controlled data. The Stage 3 proposed rule focuses on encouraging the use of EHR functionality for secure dialog and efficient communication between providers, care team members, and patients about their care and health status. It also includes imparting important health information such as preventive and coordinated care planning. The government spent USD 24.8 billion and USD 12.9 billion in Medicare and Medicaid incentive payments, respectively, during 2011–2018.
